DUI & Women: Ways How a Woman Can Fight Their DUI and Protect Their Rights

It has been statistically proven that more women are being charged and arrested for driving under the influence (DUI) than ever before. Both the courts and prosecution would have us believe that this is true because of the increase in female drinking and driving. However, there are a number of factors indicating that women are more likely than their male counter-parts to be falsely and wrongly arrested for DUI offenses.

For this reason, DUI defense for women can be a bit more of a complicated field in which a wide range of different defenses are available. Consequently, this result is due to the facts of the differences in how female bodies have been clinically proven to handle alcohol as compared to men’s handling-ability, and other issues concerning the BAC testing itself.

Female drivers are faced with additional issues when a police officer requests a woman to perform field sobriety tests (FSTs) or take a breath, blood or urine test at the police station or hospital. For example, many Breathalyzer machines inaccurately give higher readings for women due to the fact most breath screening devices are calibrated for men. This basically means that if a female driver had taken a blood test instead of a breath test at that same time, there is a stronger likelihood the BAC level would be drastically lower than what the breath test readings indicated.

Many women charged with DUI, DWI today already have enough financial hardships due to common reasons such as being a single parent or student, and don’t have the savings immediately available to hire a lawyer to fight the charges. Women have more successful DUI defenses available today, because they are more susceptible to a wrongful DUI, DWI arrest for a variety of reasons. For example, many prescription medications have been known to create false signs of DUI intoxication that affect a much larger number of women drivers than it does for men. The same issue happens with OTC medicine, especially if a female driver drank any alcohol. This can further give police assumptions of impairment, when it may not be the case at all. Even when a female driver has refused to take a breath, blood, or urine test after a DUI arrest, a legal expert reviewing the details of what happened can often provide case-specific defenses against the charges.

Another common issue for women charged with DUI is the fact nearly all of the arresting police are male officers. In most DUI, DWI arrest scenarios, a male officer is the only officer at the traffic stop when they ask a woman driver to submit to the roadside field sobriety tests and subsequently, a breath test.

Since the large majority of DUI stops happen late at night on a dark road or isolated area, women are understandably nervous to perform any roadside testing as well as any chemical BAC screening such as a breath or blood test. Consequently, a male police officer often uses this hesitation as either a test refusal, and/or exploits a woman’s nervous demeanor as consciousness of guilt of driving under the influence of drugs, Marijuana, or alcohol.

These common arrest factors which female drivers charged with DUI regularly face, can be used as a strong defense once an arrest review can pinpoint specific legal technicalities and other violations of a driver’s rights.

Female breath testing and unreliability

Expert testimony has consistently shown that when women are charged with a DUI, they are often put in a bad position by false results from the initial breathalyzer test. For a variety of reasons, the breath testing machine does not calculate female alcohol levels as accurately as it does for men.

A rare but good example of this was recently featured on many news outlets, about a woman who claims her own body brews alcohol, and has the charges dismissed when this strange reason for her high BAC level was proven by her lawyer to be true. One reason has to do with the bio-chemical and hormonal differences between the male and female physiological makeup. Another is that women metabolize and absorb alcohol differently than men.

Having your arrest evaluated by us today online, could assist with building case winning defensive instructions of ways to dismiss a DUI arrest for women. Females and roadside testing agility

All suspected DUI offenders can be potentially subject to roadside sobriety techniques if they choose to take these tests. However, when women are often intimidated into participating in roadside sobriety testing, this puts them at an immediate disadvantage.

As is accepted by most medical professionals, women react differently to stress than men do, and many have a rightful fear of getting out of their vehicles at the request of anyone, including a police officer in the process of performing their lawful duties. This heightened stress can cause a personality-slip, and thus a dip in performance in roadside tests, which your attorney in conjunction with using our free online case analysis can potentially help to show how to suppress this evidence.

What happens if a woman is asked to take one of these tests in shoes that are poor for roadside agility? This is yet another factor that after having your particular case details evaluated today, could show information that could be argued in your favor.

Female drivers are often being forced to perform these tests in uncomfortable footwear or even in bare feet which can make passing any of the roadside tests extremely difficult in any circumstance. Women are being unnecessarily targeted, and the nature on the increasing severity in DUI/DWI laws can open the door to many wrongful DUI charges and convictions. If you are a woman that has been charged with driving under the influence of alcohol, drugs, or medication, then you need to protect yourself against wrongful prosecution.

Furthermore, one of the best DUI defenses for both women and men alike, is when all too common police errors happen during a DUI, DWI roadside field sobriety tests and breath testing. 1. I went on a date with a man who ended up lying about his age and name. Went to a bar that I’ve never been to before. Right as I got there I was hit on and asked if I wanted a drink. I declined the drink and carried on with my current drink that I bought.

The man came back to me three minutes later offering me a drink again. I was uncomfortable so I left the bar and sat somewhere else. I was waiting for my date still and was offered another drink by a different man. My mistake was not seeing it be made. I thanked the man but he was confused as to what I was talking about.

I drank the drink and it tasted funny compared to my precious drink. I didn’t finish it because I simply didn’t like the way It tasted. Ended up being roofied but was not aware of that until after the situation. I was feeling a lot more drunk off one in a half drinks than i should have. I have a high alcohol tolerance so it was weird for me to be feeling drunk that early in the night.

Later that night a man tried to get me to go in his car. It was a sex trafficking scam gone wrong. Fight or flight kicked in and I fled the situation. I don’t remember a thing that happened. I blacked out because of the drug and crashed into a pole. I wasn’t arrested for DUI but I did get one.

They took my license away and gave me a restricted one. After that I was in the hospital not aware of anything that was going on. They gave me a breathalyzer test while I was at the hospital but they didn’t test my blood for any types of drugs after I told them I would like them to do that.

Overall it was a terrible situation and I’m just waiting to hear back about this situation. I’ve never gotten in trouble before so this is all new territory. The one thing I’m left with is mental health issues and the fact that I don’t really remember a big chunk of the night.

    • I am sorry to hear about this unfortunate situation you have been through. Is there any way you can get his name? Possibly report him to police? If this is from being drugged then you have a strong case to get the DUI charges dismissed but you will need some strong evidence showing you were drugged. Get a DUI lawyer right away to start helping you through the process.

I was in mental duress, the blood alcohol test results were not even back from the lab when I went to court to prove i wasn’t over the limit, no one would explain what was happening and I ended up ON MY FIRST EVER EXPERIENCE WITH THE LAW , 2 years probation, 1 year no driving, 1 year interlock, 2000.00/fines, 24 hours of community service, 2 dui classes, and 15 days in jail.
