  2. Contact a Lawyer Immediately: Your lawyer will be your advocate and guide throughout the legal process. Don’t wait – the sooner you seek legal counsel, the better.
  3. Gather Evidence: If witnesses saw the stop or you have any documentation related to the incident, keep it safe and share it with your lawyer.

Best Effective Legal Strategies That Can Help You Get Out of a DUI

Top proven reliable strategies to help with a recent DUI case in IL are:

1. Challenging the Stop

  • Probable Cause: Was the officer justified in pulling you over? If not, your lawyer may be able to get the evidence suppressed, potentially leading to dismissal.
  • Procedural Errors: Did the officer follow proper procedures during the stop and arrest? Any irregularities could be grounds for challenging the case.

Case Example: Our client, Jason, was pulled over for “weaving.” Upon closer examination, his lawyer discovered the officer lacked probable cause for the stop. The judge agreed, and the entire case was dismissed.

2. Fighting Breathalyzer Tests

  • Calibration Records: Were the breathalyzer machines properly calibrated and maintained? Inaccurate readings can be challenged.
  • Medical Conditions: Certain medical conditions can affect breathalyzer readings. Your lawyer can explore this winning DUI defense if applicable, and have the over the limit breath test results thrown out as evidence against you in court.

Case Example: Michelle, our client, has diabetes, which can affect breathalyzer results. Her lawyer presented medical evidence, leading to a serious first DUI offense getting significantly reduced to a charge of reckless driving that can be expunged from her record.

3. Using a Reasonable Doubt Defense With Field Sobriety Tests

  • Standardized Procedures: Were the field sobriety tests administered correctly? Improper administration can cast doubt on their validity.
  • Medical Conditions: Again, medical conditions can impact your performance on these tests.

Case Example: Matt, a client with inner ear issues, performed poorly on field sobriety tests. His attorney successfully argued that these tests were unreliable in his case, resulting in a lesser charge than DUI.

Remember: Every DUI case is unique. What worked for one person to beat a DUI charge in Illinois, might not apply to another defendant with totally different circumstances of how the DUI arrest happened.

That’s why it’s crucial to ultilize a free DUI attorney review online of the arrest information, since only a local Board Certified lawyer for DUI defense can analyze your specific situation and develop the most effective defense strategy to beat a recent DUI case.

  1. I was stopped for speeding. The officer made me exit my vehicle. The officer prolonged the stop after he told me I was getting a ticket for speeding, to conduct a dog sniff of my vehicle, because he said I was acting goofy. The officer searched my vehicle looking for drugs and found an open container of alcohol and arrested me for dui, speeding, and transporting alcohol. What can I do about the officer prolonging the stop to conduct the dog sniff on my vehicle? I do have video.
